Bill Cosby faces retrial on sexual assault charges
A Pennsylvania judge has declared a mistrial after a jury failed to reach a verdict in the trial of comedian Bill Cosby, who is accused of drugging and sexually assaulting a woman more than 13 years ago.
Read the original report below.
Consisting of seven men and five women, the jury began deliberation on Monday after hearing closing arguments.
The judge asked each individually: "Do you agree that there is a hopeless deadlock that can not be resolved by further deliberations?"
Cosby's wife of almost 50 years, Camille, was seated in the courtroom on Monday for the closing remarks, and watched as the 79-year-old comedian's lead lawyer, Brian J. McMonagle, insisted that the alleged incident between Cosby and Constand was consensual and that their relationship was romantic in nature. She is now representing 33 women who have accused Cosby of sexual assault.
During the deliberations, the panel asked several times to revisit key evidence, including Cosby's decade-old admissions that he in fact did fondle Constand after giving her pills in 2004.
Dangerous heat wave to scorch the Southwestern US
A less severe heat advisory was issued Friday for the inland cities of Escondido, San Marcos, Poway, La Mesa, El Cajon and Santee. In Southern California, the hottest temperatures will be in the deserts with highs over 110 degrees.
And so after 52 hours of deliberations, the sexual assault trial of Bill Cosbyended in a mistrial.
District attorney Kevin Steele, who prosecuted the case, said he will retry the case but that Cosby remains free on bail until a new trial date is set, ideally within 120 days. He also dismissed the district attorney's pledge to retry the case. His defence argued that Constand had consented to sex with Cosby.
The jury has spent days reviewing large chunks of trial testimony, including both Cosby's and Constand's accounts of the night in question. Instead, a publicist read a blistering statement from his wife, Camille, who had been in court during one day of the trial but was not at the courthouse Saturday. She described how Cosby gave her pills and then penetrated her with his fingers as she lay paralyzed on a couch, unable to tell him to stop.
Bill Cosby exits the Montgomery County Courthouse after a mistrial in his sexual assault case in Norristown, Pa., Saturday, June 17, 2017. They must decide whether their case is strong enough to justify another high-profile trial, while the two alleged victims who testified against Cosby must determine their willingness to undergo another round of bruising cross-examination. But it would take a series of broad shifts - in the public's perception of Cosby and his many accusers, and in the makeup of the prosecutor's office - before he was charged with a crime, more than 11 years later. The deposition's in Constand's civil suit were released and the Montgomery County D.A.'s office chose to reopen the case and arrested Cosby.
