Judge Declares Mistrial, Again, In Cincinnati Police Shooting Case

A judge has declared a mistrial in the case against a former OH police officer accused of voluntary manslaughter.

Protesters have been stationed outside the Hamilton County Courthouse for several days, and usually numbered between five and 15.

"This is the most asinine act I have ever seen a police officer make", he said at the time.

Jurors in Tensing's first trial told the judge they were hopelessly deadlocked and were sent back into deliberations two times before she declared a mistrial.

The heightened scrutiny on police shootings and other uses of force has flared up after deaths of black men, women and boys in places such as Ferguson, Mo., Baltimore, New York, Baton Rouge, Cleveland, Seattle and San Francisco.

The jury had been deliberating for more than 27 hours.

But prosecutors said a review of police body camera footage showed Tensing was not in danger during the July 2015 incident and that the officer was not dragged.

Judge Leslie Ghiz addressed the jurors Friday morning after they said they could not reach a unanimous verdict.

"I think they're going to vote for murder, and that's what this (delay) means", Allen said.

The shooting is among those across the nation that have raised attention to how police deal with blacks.

A Wisconsin jury earlier this week acquitted Dominique Heaggan-Brown in the killing of Sylville Smith, who was carrying a semi-automatic pistol during a brief foot chase. Tensing has claimed he shot DuBose in self-defense, alleging DuBose tried to speed off from the stop. "Do I disengage and let Sam DuBose drive away or do I kill him?"

During that time, four officers were acquitted by juries.

"They were about to hang him out to dry", Mathews said, but authorities eventually came down on the pilot's side because "human factors" were considered.

"Based on my time and training with internal investigations", she testified, "I thought I was looking at an officer-involved shooting where his actions may be determined to be justified based on the events surrounding the actual shooting and taking into consideration the information about the prior conduct of Mr. DuBose and Officer Tensing".

Tieger agreed with defense attorneys that DuBose did not comply with Tensing's commands but said that wasn't justification to shoot. The school also agreed to set up a memorial to DuBose on campus, invite the family to take part in meetings on police reform, issue a formal apology and provide free undergraduate education to DuBose's 12 children.
