Appeals court vacates Ezekiel Elliott injunction

According to multiple media outlets, a federal appeals court has ruled in favor of the National Football League in the matter of Ezekiel Elliott's six-game suspension.

As things stand, Ezekiel Elliott will not be starting at running back for the Cowboys when the team returns to the field October 22 against the 49ers.

Elliott was previously accused of domestic violence in OH, but police chose not to press charges.

As of last Friday, there had been no settlement discussions between the NFL and Elliott's representatives, according to NFL Network's Tom Pelissero.

"So the Players Association could ask the district court in NY or perhaps some other court to reinstate the preliminary injunction, which would put that suspension back on hold", Feldman said on NFL Network's TNF First Look.

After NFL commissioner Roger Goodell announced the six-game suspension in August, Elliott's camp appealed to the league.

The NFL, maintaining that it adhered properly to the sport's disciplinary procedures, quickly sought the intervention of the New Orleans-based appeals court.

The ruling finds that the NFLPA was premature in filing a lawsuit on Elliott's behalf before arbitrator Harold Henderson ruled on Elliott's appeal and that the district court "lacked subject matter jurisdiction when it issued the preliminary injunction" as a result.

On Thursday afternoon, the USA 5th Circuit Court of Appeals sided with the NFL. In its ruling, the 5th Circuit agreed with league attorneys who argued that Elliott prematurely sued the league September 1.

The circuit court's ruling does not mean Elliott's fight is over.

When the union filed its case in defense of Elliott in Texas, the N.F.L. filed a separate motion in the Southern District of NY, where it argued that that court was the appropriate venue for the league and players to settle their disputes.

The Manhattan court will be charged with making the same decision already made by Mazzant - whether the league's disciplinary process was "fundamentally unfair" to Elliott. He may have to serve his suspension, effective immediately.

The league won the "Deflategate" decision in the NY court, leading to New England quarterback Tom Brady serving his four-game suspension a year after it was originally imposed.
