The new charges come less than a week after a San Francisco jury acquitted Jose Ines Garcia Zarate of homicide for the shooting death of Kate Steinle, a case that helped fuel a fierce national debate on immigration. During his murder trial, Zarate admitted to firing a single shot from a.40 caliber Sig Sauer and hitting Steinle as she walked with her father on a San Francisco pier on July 1, 2015.
The state conviction carries a maximum sentence of three years in jail.
Zarate, who has been in jail since the day of the shooting, will be deported once he serves his sentence, according to immigration authorities. Officials said the indictment "merely alleges that a crime has been committed and Garcia-Zarate, like all defendants, is presumed innocent until proven guilty beyond a reasonable doubt".
He added that Garcia-Zarate would ultimately be deported.
The 47-year-old said the firearm accidentally fired when he picked it up, and the bullet ricocheted off the ground before it struck Steinle, a 32-year-old medical device saleswoman.
The case also caught the attention of presidential candidate Donald Trump previous year, who used it to highlight crime committed by undocumented immigrants during his campaign.
Garcia-Zarate is a seven-time convicted felon and had been deported from the US five times.
Sessions slammed the verdict Friday, telling Fox News that "it's time for this country to get its head on straight" because sanctuary cities like San Francisco "should not be protecting criminal aliens".
