US: Supreme Court allows Trump's 'travel ban' to enter effect
The 9th U.S. Circuit Court of Appeals, based in California, and a federal judge in Maryland adopted that standard and applied it to Trump's latest order.
Iran, for example, will still be able to send its citizens on student exchanges, though such visitors will be subject to enhanced screening.
In support of the ban on Monday spoke of seven judges, armed forces, voted against only two.
Iran's Foreign Minister Mohammad Javad Zarif slammed the U.S. travel ban on travelers from six mainly Muslim countries in a tweet Monday. The 4th U.S. Circuit Court of Appeals, based in Richmond, Va., and the 9th Circuit are scheduled to hear arguments this week on whether Trump's latest order discriminated based on nationality in violation of a 1965 law.
The SC order has not explained the reasons for its decision but nudged the lower courts that are hearing the arguments on the merit of the case to move faster.
The court did not issue an opinion with the order, but usually the justices do not intervene in pending cases unless they believe the lower courts have gone wrong.
But the Supreme Court giving the go-ahead shouldn't be taken as the justices saying they agree with the ban, says Matt Adams, the legal director of the Northwest Immigrant Rights Project.
"We are not surprised by today's Supreme Court decision permitting immediate enforcement of the President's proclamation limiting travel from countries presenting heightened risks of terrorism", White House spokesman Hogan Gidley said after the order.
Russia's justice ministry yesterday named nine USA media outlets including Voice of America as "foreign agents" after President Vladimir Putin signed a law last month allowing global media to be slapped with the controversial label. "It's unfortunate that the full ban can move forward for now, but this order does not address the merits of our claims". A federal judge in Seattle soon blocked it, and since then, courts have wrestled with the restrictions anew as the administration has rewritten them.
The Presidential Proclamation did not set an end date for these restrictions.
"The proclamation is lawful and essential to protecting our homeland". The appeals courts are also considering claims that the ban reflected unconstitutional bias against Muslims. "We will be arguing Friday in the Fourth Circuit that the ban should ultimately be struck down", Jadwat said.
Lawyers for Hawaii, which is challenging the ban, told the justices that there was no reason to make changes now.
If anything, it said, the government's case has weakened. "But the justification for that dramatic relief has only weakened".
Mr. Francisco asked the justices to allow every part of the third ban to go into effect.
Instead of previous temporary travel bans, the president now "has imposed an indefinite one, deepening and prolonging the harms a stay would inflict", says the brief submitted on Hawaii's behalf by Washington lawyer Neal Katyal.
"Now that the review has been completed and identified ongoing deficiencies in the information needed to assess nationals of particular countries", he wrote, "additional restrictions are needed".
