US Supreme Court Will Hear Texas' Redistricting Cases

US Supreme Court takes up fight over Texas electoral districts

A "use" is supposedly imposed directly on a consumer who buys from a seller that has no duty to collect a sales tax; some out-of-state retailers do agree to collect such a tax from South Dakota buyers, but that can't be enforced so it is not done universally. Instead, Texas asked the Supreme Court to put the rulings on hold until justices could review the ruling's merits. Since it doesn't have a state income tax, sales taxes are that much more important to the state budget.

In its brief to the Supreme Court, the National Retail Federation said that software is now widely available that makes it easy for retailers to collect sales tax.

NetChoice Executive Director Steve DelBianco has said many thousands of smaller businesses would bear disproportionate burdens and costs if they are forced to become tax collectors for 12,000 jurisdictions across 46 states.

The NSGA supports H.R. 2193, the Remote Transactions Parity Act and S. 976, the Marketplace Fairness Act, which the trade group said would level the playing field by permitting all states that have a sales tax to require out-of-state internet sellers to collect state sales tax.

The Supreme Court on Friday agreed to hear Texas's appeal of a lower court decision to strike down the state's congressional and legislative voter maps.

South Dakota began the legal fight by filing suit against four retailers soon after the law was enacted: Wayfair,, Newegg Inc and Systemax Inc.

Heitkamp said she looks forward to attending the arguments, which will likely take place in April. Justice Anthony Kennedy wrote a concurring opinion in a 2015 case urging his colleagues to reconsider the ruling at an appropriate time in the future. Previously, there were two separate cases: One for the state's congressional map, and one for the Texas House map.

The Texas dispute dates back to 2011, when the GOP-dominated legislature created new congressional and state legislative districts to help Republicans, even though the growth in the state's population was nearly entirely attributable to minorities who more often vote Democratic.
