MS close to having most-restrictive abortion law in US
09 March 2018, 06:14 | Brandon Parsons
Mississippi bans abortions after 15 weeks, no exception for rape or incest
Diane Derzis, who owns the only abortion clinic in MS, said in January that she believes the bill is "clearly unconstitutional".
The measure would ban the procedure after about 11 weeks of pregnancy, except in medical emergencies.
The unsanitary and unsafe conditions of Gosnell's abortion facility, revealed during the trial, which received much media coverage, led to a renewed urgency in many state legislatures to regulate abortion facilities.
The Center for Reproductive Rights and Planned Parenthood argue that the bill is unconstitutional, citing similar legislation that has been struck down when challenged in court. It's a big step for Bryant, who said in 2014 that his goal was "to end abortions in MS", which the 15-week ban will functionally do. One is protecting the health and life of the mother.
State Sen. Deborah Dawkins, a Democrat, said the bill harms women. A 1992 Supreme Court decision upheld the right to an abortion until fetal viability, which is not a fixed medical term but generally falls around 24 weeks. "House Bill 1510 will help us achieve that goal", the governor tweeted on Tuesday, as reported by Associated Press.
Abortion opponents have been encouraged by a 2007 Supreme Court case, Gonzalez v. Carhart, that allowed bans on what some call partial-birth abortions, an abortion performed relatively late in pregnancy, in which the living fetus is extracted in stages through the birth canal. There are no exceptions for pregnancies caused by rape or incest. For example, it tossed out a North Dakota law that banned abortions as early as six weeks into a pregnancy and an Arkansas law that banned abortions at 12 weeks.
Both bills were authored by State Senator Travis Holdman of (R-District 19), just south of Fort Wayne.
The proposal cleared its first hurdle Wednesday, but it's already drawing threats of a legal challenge if the limits on abortions after about 11 weeks of pregnancy become law. The clinic's owner, Diane Derzis, told local media that they plan to sue and fears the clinic will now have to refer people to out-of-state providers.
The likely hope of MS lawmakers is that one of the justices more favorable to abortion rights, such as Anthony Kennedy or Ruth Bader Ginsburg, will have stepped down by the time the state's case reaches the Supreme Court.
Taylor said the Alliance Defending Freedom, a Christian conservative legal advocacy group, was among those who vetted the bill's language. Gipson said lawmakers in Texas, Georgia, and "some Midwestern states" are exploring the idea.
"The decision to terminate a pregnancy should be made exclusively by each individual woman in consultation with those she trusts the most, including people like me, an obstetrician-gynecologist, and not politicians", said Hoffman.
